Frequently Asked Questions Regarding Open Burning Regulations
1. Do I need a permit to have a campfire?
Cooking fires are allowed without a permit, so as long as you are using the campfire to cook food you are exempt from the permitting requirements. Campfires not used for cooking food are not allowed without a permit.
2. What is the penalty for violating the open burning regulations?
Violators are issued a written citation and fine of $100.00 from the local fire department and are subject to additional violation and fines issued be the State DEP.
3. Are chimineas and outdoor fireplaces subject to the requirements of Open Burning?
No, they are exempt from these regulations. The regulation does however give the fire department authority to shut down any outdoor device which in the opinion of the fire department is creating a nuisance or a hazard.
4. Why are leaves not permitted to be burned?
Because leaves tend to generate excessive amounts of smoke when they burn, creating a nuisance and unhealthy air quality.
5. What is an Agricultural Burning Permit?
An Agricultural Permit is a permit issued to a farm or other entity wishing to burn brush to aid them in their pursuit of agriculture. Agricultural Permit holders are allowed to burn year round and can also start their earlier in the day.
6. If I am not allowed to use gasoline or kerosene to light my fire, how should I light it?
Start out with a small pile of smaller, dry pieces of wood and kindling. light the small pile with a match and as the kindling begins to burn add slightly larger pieces until the fire is the size you like.
7. Can I burn brush at the location of my business or commercial property?
No. The regulations only allow burning by private individuals at residential locations. Burning is not allowed at any commercial or industrial locations.
8. How many fires am I allowed to have during the season?
There is no restriction on the number of fires an individual permit holder has during the course of a season.
9. What are the limitations on what I can burn?
You can not burn any building materials, stumps, hay, grass, leaves, pine needles, rubbish of any kind, materials greater than 4 inches in diameter or unseasoned or wet brush that creates excessive amounts of smoke.
10. Can I burn any day during the season?
Burning is permitted seven days a week however if the weather is dry, windy or the air quality is poor, the fire department will not allow burning.
